EU Digital Services Act Information

We are committed to complying with our obligations under Regulation (EU) 2022/2065 (the Digital Services Act, “DSA”). Our Digital Services Coordinator of establishment is the Italian Communications Authority (AGCOM).
Service classification
For the purposes of the DSA, Evernote is a hosting service within the meaning of article 3(g): we store information provided by, and at the request of, the recipients of the service, and we make that information available in accordance with the instructions and settings each user chooses.
Content in an Evernote account is private by default. Where a user chooses to share content, sharing is directed by that user to specific recipients or through a link that the user generates and distributes. The service does not offer any of the following:
- Browsing or public search across content stored by other users
- Curated discovery, trending or editorial surfaces
- Content recommendations, personalized feeds, or a recommender system within the meaning of article 3(s) of the DSA
- Profiles, followers, comments, or other social networking features
Evernote is therefore focused on user-directed storage and sharing of a user’s own content, rather than on the dissemination of information to the public. On this basis, we consider that Evernote is not an online platform within the meaning of article 3(i) of the DSA, and that the obligations the DSA imposes specifically on providers of online platforms do not apply to the service. The obligations applicable to providers of intermediary services and of hosting services do apply, and are addressed below.
Orders to act against illegal content
We comply with valid orders issued by the judicial or administrative authorities of EU Member States to act against one or more specific items of illegal content, in accordance with article 9 of the DSA and applicable law.
On receipt of such an order we send the issuing authority, without undue delay, confirmation of receipt and information on the effect given to the order, specifying the action taken and the date on which it was taken. We also inform the user who provided the content of the order and of the action taken, at the latest at the time the action takes effect, unless we are legally prohibited from doing so or the order provides otherwise.

Orders to provide information
We comply with valid orders issued by the judicial or administrative authorities of EU Member States to provide specific information about one or more specific recipients of the service, in accordance with article 10 of the DSA and applicable law. We send the issuing authority confirmation of receipt and information on the effect given to the order without undue delay.
We inform the user concerned of the order and of the information disclosed unless we are legally prohibited from doing so or the order provides otherwise. Further information on how we handle requests from law enforcement and other authorities is set out in Information for Law Enforcement Authorities.
Single point of contact for authorities
In accordance with article 11 of the DSA, we have designated the following single electronic point of contact for the authorities of EU Member States, the European Commission and the European Board for Digital Services, for matters relating to the DSA:

Single point of contact for users in the European Union
We provide the following point of contact that allows users to communicate with us in accordance with article 12 of the DSA:
Submit a Request. Communications through this channel are not handled solely by automated means. Users may also communicate with us through the other channels we make available for that purpose. Communications may be in English or Italian.
To report content, the fastest route is the in-service reporting flow described under “Reporting illegal content” below.
Terms and conditions and content moderation
The rules governing the use of Evernote, including restrictions on the content users may store and share and the measures we may take in response to violations, are set out in the following pages, in accordance with article 14 of the DSA:
Transparency reporting
We publish, at least once a year, a report on the content moderation we engaged in during the relevant period in accordance with article 15 of the DSA. The first relevant period will be the one between October 1, 2026 and December 31, 2026.
Reporting illegal content
Any individual or entity, —whether or not they hold an Evernote account, may notify us of content stored on Evernote that they consider to be illegal under article 16 of the DSA as follows:
- If a user has access to the content in the Evernote service, they may open the note, select More actions, and then Report this note.
- If a user does not have access to the content in the Evernote service, they may submit a notice throughSubmit a Request or through the other channels we make available for that purpose.
Statement of reasons for content moderation decisions
Where we restrict the visibility of content, remove or disable access to it, suspend or terminate an account, or suspend or terminate the provision of the service in whole or in part, we provide the affected user with a clear and specific statement of reasons in accordance with article 17 of the DSA and applicable law.
